Terms of Service

1. Acceptance of Terms
By accessing or using genvi ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. genvi is operated by genvi Labs ("we," "us," or "our").
2. Description of Service
genvi is a node-based AI creative studio that enables users to build visual workflows, generate images and videos using AI models, compose timelines, and manage media files. The Service operates on a "Bring Your Own Key" (BYOK) model, requiring users to provide their own API credentials for third-party AI providers.
3. Account Registration
To use genvi, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
Accounts may be created via email/password or Google Single Sign-On (SSO).
4. API Keys and Third-Party Services
4.1 Bring Your Own Key (BYOK) Model: genvi requires users to supply their own API keys for third-party AI providers (including but not limited to Google AI, xAI). You are solely responsible for obtaining, securing, and managing these API keys.
4.2 Key Security: API keys you provide are encrypted at rest using industry-standard encryption (Supabase Vault/pgsodium) and are only decrypted server-side during API calls. Keys are never exposed in browser responses or client-side code.
4.3 Third-Party Terms: Your use of AI models through genvi is subject to the terms and conditions of the respective AI providers (Google AI, xAI, etc.). You are responsible for compliance with these third-party terms.
4.4 Usage Costs: You are responsible for all costs incurred through your API keys. genvi does not mark up or charge additional fees for AI model usage.
5. Acceptable Use
You agree not to use genvi to:
- Generate illegal content, including but not limited to CSAM, violence, or non-consensual imagery
- Create content that infringes on intellectual property rights
- Produce deceptive content intended to mislead or defraud (deepfakes for malicious purposes)
- Violate the terms of service of third-party AI providers
- Attempt to reverse engineer, hack, or exploit the Service
- Use the Service to distribute malware or engage in cyberattacks
- Store or transmit content that violates applicable laws
We reserve the right to suspend or terminate accounts violating these policies without notice.
6. Content and Intellectual Property
6.1 Your Content: You retain all rights to the content you create, upload, or generate using genvi. This includes prompts, uploaded files, and AI-generated outputs.
6.2 AI-Generated Content Rights: Subject to the terms of the underlying AI providers, you own the outputs generated through your workflows. However, we make no warranties regarding the uniqueness or originality of AI-generated content.
6.3 License to genvi: By using the Service, you grant genvi a limited, non-exclusive, royalty-free license to store, process, and transmit your content solely for the purpose of providing the Service to you.
6.4 Trademarks: The genvi name, logo, and branding are the property of genvi Labs. You may not use our trademarks without prior written consent.
7. Storage and Data
7.1 Storage Allocation: Free and Pro accounts include 5 GB of cloud storage for files generated or uploaded through the Service.
7.2 Data Retention: We retain your files and project data as long as your account is active. Upon account deletion, all associated data is permanently removed within 30 days.
7.3 Backups: While we maintain backups for disaster recovery, you are responsible for maintaining copies of important content outside of genvi.
8. Payment and Billing
8.1 Subscription Plans: genvi offers free and paid subscription plans. Features and limits vary by plan tier.
8.2 Billing: Paid subscriptions are billed in advance on a recurring basis. You authorize us to charge your payment method for all applicable fees.
8.3 Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
8.4 Refunds: All sales are final unless otherwise required by applicable law.
9. Service Availability
We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or factors beyond our control.
genvi is provided "as is" without warranties of any kind, either express or implied.
10. Limitation of Liability
To the maximum extent permitted by law, genvi Labs shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Costs of substitute goods or services
- Damages resulting from third-party AI provider outages or errors
- Issues arising from your API keys or account credentials
Our total liability shall not exceed the amount you paid to genvi in the 12 months preceding the claim, or $100 if no payment was made.
11. Indemnification
You agree to indemnify and hold harmless genvi Labs, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.
12. Termination
12.1 By You: You may delete your account at any time through the Account Settings page or by contacting support.
12.2 By Us: We may suspend or terminate your account for violations of these Terms, fraudulent activity, or extended inactivity.
12.3 Effect: Upon termination, your access to the Service ceases. We may retain anonymized usage data for analytical purposes.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
